Do You Really Want the Marital Home?

When it comes to property division, a couple’s ownership in the marital home often represents one of, if not the, largest assets.  In dividing any real estate, there are a number of questions you need to answer:

1. Have you considered from the standpoint of an economic business decision whether it is in your best interest in the long-run to sell or keep the home?

2. Do you know how title is held, not only to the home, but to all pieces of real estate you and your partner own?

3. Do you know the source of the down payment?  Did you use inheritance or property you or your spouse had prior to the marriage?  If so, let our attorneys know so that we can address this when addressing the issues related to who gets what

    

   Even if you know the source of the down payment, do you have records to show said source?

5. Do you have copies of your state and federal tax returns for all the years of your marriage which support those points above?
